The Service

NachaGuard provides ACH batch file scanning, fraud detection analysis, and compliance documentation tools. We analyze files you upload and return fraud detection results, compliance certificates, and AI-generated audit narratives. We do not transmit, modify, or interact with your ACH files beyond the analysis described.

Your Responsibilities

You are responsible for the accuracy of files you upload and for all decisions made based on NachaGuard's output. NachaGuard's reports are analytical tools — they do not constitute legal, financial, or regulatory advice. You remain responsible for your organization's Nacha compliance program.

What We Guarantee

We will process your uploaded files accurately against the NACHA Operating Rules specification. We will maintain your data securely per our Privacy Policy. We will provide audit logs and compliance certificates for every completed scan.

What We Do Not Guarantee

NachaGuard does not guarantee detection of all fraudulent entries. No automated fraud detection system provides 100% coverage. NachaGuard significantly reduces your exposure and provides compliance documentation — it does not replace internal controls or constitute a complete compliance program.

Pricing and Cancellation

The first 60 days of service are provided free of charge with no credit card required. After the trial period, service continues at $499/month unless cancelled. You may cancel at any time with no penalty. No refunds are provided for partial months after the trial period.

Liability

NachaGuard's liability is limited to fees paid in the 30 days preceding any claim. We are not liable for losses resulting from fraudulent ACH entries not detected by our system, decisions made based on our reports, or interruptions in service.

Governing Law

These terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Erie County, New York.

Changes to Terms

We will notify you by email at least 14 days before making material changes to these terms.
